Terms of Service

These Terms govern your use of the FundWillow School Partners platform ("FundWillow," the "Service") at fundwillow.com. By creating an account or using the Service you agree to these Terms. If you are agreeing on behalf of a school or booster club, you represent that you have authority to bind that organization.

1. The Service

FundWillow provides fundraising tools for schools, booster clubs, and partner organizations — including dialers, SMS, email, printed mailers, payment processing via Stripe Connect, and related reporting. The specific features available to you depend on your plan.

2. Accounts and eligibility

• You must be at least 18 to create an account, or a minor acting under a school's supervision.
• You are responsible for the accuracy of information you provide and for safeguarding your credentials.
• You must promptly notify us of any unauthorized access to your account.

3. Subscription, fees, and payouts

• Annual subscription fees are invoiced in advance. Stripe payment processing fees apply to donations (standard 2.9% + 30¢, subject to change by Stripe).
• Donations are routed to the school's connected Stripe account. FundWillow is not a party to the donation transaction and does not hold donor funds.
• Subscription fees are non-refundable except where required by law or as explicitly agreed in writing.

4. Your content and data

You retain ownership of the data you upload — lead lists, templates, recordings, logos. You grant FundWillow a limited license to host, process, and transmit that data to operate the Service. You represent that you have the rights to share every piece of content you upload and that your outreach complies with all applicable laws (see Acceptable Use).

5. Compliance responsibilities

• You are responsible for complying with CAN-SPAM, TCPA, state calling laws, recording-consent laws, A2P 10DLC carrier rules, and applicable privacy laws.
• FundWillow provides tooling (opt-out handling, STOP keywords, disclosures, audit logs) but cannot guarantee compliance given you control what is sent, when, and to whom.
• Do not upload contact lists you do not have a lawful basis to message.

6. Service availability and support

We target 99.5% monthly uptime for the core Service. Scheduled maintenance will be announced in advance when practical. Support is provided by email at support@fundwillow.com during business hours.

7. Termination

Either party may terminate a subscription effective at the end of the then-current term. We may suspend or terminate an account immediately for material breach, abuse of the Service, or risk to other users. On termination we will make a reasonable effort to return your data in a standard export format for 30 days, after which we may delete it.

8. Warranties and disclaimers

The Service is provided "as is." To the maximum extent permitted by law, FundWillow disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, FundWillow's aggregate liability for any claim arising from the Service will not exceed the amount you paid to FundWillow in the 12 months preceding the event giving rise to the claim. Neither party is liable for indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

You will defend, indemnify, and hold harmless FundWillow from claims arising out of your content, your outreach, your violation of these Terms or applicable law, or your violation of a third party's rights.

11. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. The state and federal courts located in New Jersey have exclusive jurisdiction over any dispute not subject to arbitration.

12. Changes

We may update these Terms from time to time. Material changes will be posted here and communicated to account owners. Continued use after the effective date constitutes acceptance.
